Roy Martin, JD, is an accomplished divorce attorney who assists parties in negotiating settlement. Specifically:

1. He provides legal advice to his client and document preparation services in uncontested divorce and family law matters. (In those cases, he represents one party and can assist the other party in finding another settlement oriented attorney to consult with upon request);
2. He provides representation to one party in mediated divorce and family law settings;
3. He can serve as mediator, in which case he would not represent either party. That means he would assist them in having effective conversations to settle the case but not provide either party with legal advice and he would not draft settlement documents. (He would instead suggest other attorneys to provide legal advice and assist with document preparation).
4. He can represent one party in a collaborative divorce process and, upon request, assist the other in finding collaborative representation. (A collaborative divorce requires two collaboratively trained attorneys. In this process, both parties and both attorneys agree to keep the case out of court and to fully disclose all relevant information. Other professional team members assist the parties as well -- typically a divorce coach, a child specialist if there are children, and a financial specialist if it would be helpful to have one.)

Please understand that an attorney cannot represent both parties in a divorce or family law case.

Mr. Martin does not represent clients in contested court litigation cases. He views the court as analogous to the hospital emergency room. It may be necessary in some cases. For example, if a party is hiding income or assets, running up debt, threatening or committing acts of violence, it may be necessary to go to court. But it comes at a cost, particularly when people hope to parent their children well together post divorce. So, for those families capable of working together, he seeks to provide the support and containment of emotion that is necessary to assist the family ending their marriage through a peaceful process.

If your case is before the court or if you feel that court will be necessary because the other party is unwilling or unable to act in good faith, you will need to find an attorney who litigates. Mr. Martin handled his share of those cases through the years but has since given up litigation to focus his entire practice on providing peacemaking services.
